1. General
These Terms and Conditions govern the use of the Fittalon website and the commercial relationship between Fittalon (Tonglan (Dezhou) Machinery Technology Co., Ltd.) and its customers. By contacting us or placing an order, you agree to these terms.
2. Quotes and Pricing
A written quotation is an invitation to purchase and is not a binding offer. Final prices, terms and conditions are confirmed in the sales contract. Prices are in USD (or as agreed) and exclude international shipping, customs duties and local taxes unless stated otherwise. Quotations remain valid for the period stated on the quotation document.
3. Orders and Payment
An order becomes binding only after both parties sign the sales contract or issue a mutually confirmed proforma invoice. Payment terms (deposit, balance and payment method) are specified in the contract. Goods are produced after the deposit is received; the production schedule starts from that date.
4. Delivery and Shipping
Delivery time stated in the quotation is an estimate based on the confirmed contract date. Fittalon is not liable for delays caused by force majeure, shipping line congestion, customs inspections or other events beyond our reasonable control. Shipping cost, insurance and Incoterms (EXW, FOB, CIF, DDP, etc.) are agreed per order.
5. Inspection and Acceptance
The customer is entitled to inspect and test the goods at our factory before shipment, or to request photos/videos of the finished goods prior to dispatch. Any quality issue must be reported in writing within 7 days of receipt, supported by photo/video evidence.
6. Warranty and After-Sales
Commercial fitness equipment carries a 12-month warranty against manufacturing defects, starting from the shipping date. The warranty covers repair or replacement of defective parts at our discretion. It does not cover damage caused by misuse, improper installation, unauthorized modification or normal wear items (e.g. grips, pads, cables). Spare parts and technical documentation are available for the service life of the machine.
7. Intellectual Property
All product designs, images, texts and logos on this website are the property of Fittalon. OEM/ODM customers own the private-label branding applied to their orders; Fittalon retains ownership of underlying designs and production know-how unless otherwise agreed in writing.
8. Limitation of Liability
To the maximum extent permitted by law, Fittalon's total liability arising from any order shall not exceed the amount paid by the customer for the goods concerned. We are not liable for indirect, incidental or consequential losses, including loss of profit or business interruption.
9. Governing Law and Disputes
These terms are governed by the laws of the People's Republic of China. Any dispute shall first be resolved through friendly negotiation; if not resolved, the dispute shall be submitted to the competent court in Dezhou, Shandong, China, unless mandatory consumer protection law in the customer's country provides otherwise.
